Welcome to NexDeys. This Disclaimer governs your access to and use of the NexDeys website, mobile applications, and related digital services operated by NexDeys (OPC) Private Limited ("NexDeys", "Company", "we", "our", or "us").
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to this Disclaimer together with our Privacy Policy, Terms & Conditions, Refund & Cancellation Policy, and other applicable platform policies. If you do not agree with this Disclaimer, you should discontinue using the Platform.
NexDeys is a technology-enabled marketplace platform that facilitates discovery, booking coordination, communication, and payment facilitation between users and independent third-party automotive service providers ("Vendors").
NexDeys does not own, operate, manage, employ, supervise, or control the businesses listed on the Platform. All automotive services available through the Platform are independently offered and performed by Vendors operating under their own business responsibility.
Nothing contained on the Platform shall be construed as creating any partnership, joint venture, employment relationship, agency, franchise, or fiduciary relationship between NexDeys and any Vendor.
All Vendors listed on the Platform remain solely responsible for their services, pricing, operational practices, staff conduct, service quality, statutory registrations, licences, tax compliance, insurance obligations, and compliance with applicable laws.
Although NexDeys may undertake reasonable verification procedures before onboarding Vendors, NexDeys does not guarantee that every Vendor will continuously satisfy every user's expectations or operational requirements.
The information made available through the Platform, including service descriptions, pricing, photographs, operating hours, promotional content, blogs, educational material, FAQs, availability information, and other content, is provided for general informational purposes only.
While NexDeys makes commercially reasonable efforts to maintain accurate and updated information, the Company does not warrant that all information will always be complete, accurate, reliable, current, or error-free.
Information published on the Platform may be modified, corrected, updated, suspended, or removed without prior notice.
Prices displayed on the Platform may include applicable taxes, platform charges, promotional adjustments, discounts, convenience charges, or other applicable amounts as determined at the time of booking.
The final amount payable shall always be the amount displayed to the user before payment confirmation.
Prices, promotions, discounts, offers, applicable charges, and booking conditions may change from time to time without prior notice unless already confirmed through a completed booking.
Vendor availability, booking slots, estimated waiting periods, operational timings, service durations, and appointment schedules displayed on the Platform are indicative estimates only.
Actual availability may vary depending upon operational conditions, Vendor capacity, weather, equipment availability, traffic conditions, staffing, technical issues, force majeure events, or other circumstances beyond the reasonable control of NexDeys.
Accordingly, NexDeys does not guarantee uninterrupted Vendor availability, immediate booking confirmation, exact appointment timings, or uninterrupted Platform availability.
The content published on the Platform is intended solely for general informational purposes.
Nothing contained on the Platform shall constitute legal advice, tax advice, financial advice, insurance advice, engineering advice, mechanical certification, vehicle inspection certification, warranty, guarantee, or professional opinion.
Users should independently evaluate any information before making decisions relating to vehicle servicing, repairs, maintenance, or related services.
The Platform may integrate with third-party payment gateways, banking partners, map providers, cloud infrastructure providers, messaging providers, verification providers, analytics providers, telecommunications providers, and other service partners.
NexDeys shall not be responsible for interruptions, delays, inaccuracies, failures, or limitations arising solely from third-party systems that remain beyond the reasonable control of the Company.
The use of third-party services may also be governed by the respective terms and privacy policies of such providers.
Users acknowledge that all automotive services booked through the Platform are independently performed by third-party Vendors.
NexDeys does not directly supervise, inspect, or control the execution of any service and therefore shall not be responsible for any loss, damage, delay, defect, dissatisfaction, negligence, accident, omission, or act arising from the performance or non-performance of services by any Vendor.
Users are advised to inspect their vehicle before and after service and promptly report any concerns directly to the Vendor and, where appropriate, through NexDeys support channels for facilitation.
Users are responsible for providing accurate booking information, maintaining updated contact details, arriving within the applicable booking window, complying with Platform policies, and cooperating with Vendor verification procedures where required.
Users are also responsible for removing cash, valuables, confidential documents, electronic devices, and other personal belongings from their vehicles before handing them over for servicing.
NexDeys shall not be responsible for any loss of personal belongings left inside a vehicle before, during, or after completion of the service.
Payments made through the Platform are processed using authorised third-party payment service providers.
While NexDeys undertakes commercially reasonable efforts to facilitate secure payment processing, the Company does not control banking networks, payment gateways, card networks, UPI infrastructure, or financial institutions involved in processing transactions.
Accordingly, NexDeys shall not be responsible for delays, interruptions, transaction failures, banking outages, settlement delays, technical errors, or other issues arising solely from third-party financial systems beyond its reasonable control.
The Platform may contain links to third-party websites, applications, or services for user convenience.
Such links do not constitute an endorsement, approval, recommendation, partnership, or guarantee by NexDeys regarding the accuracy, reliability, legality, or security of any third-party content or services.
Users access third-party websites entirely at their own discretion and subject to the respective terms and privacy policies of those third parties.
Unless otherwise expressly stated, all intellectual property rights relating to the Platform, including its software, source code, databases, trademarks, logos, trade names, branding, user interface, designs, graphics, layouts, content, workflows, documentation, business methodologies, operational processes, and other proprietary materials are owned by or licensed to NexDeys (OPC) Private Limited and are protected under applicable intellectual property laws.
Nothing contained on the Platform grants any licence, assignment, ownership, or other rights in favour of any user except the limited right to access and use the Platform strictly in accordance with applicable policies.
Users shall not, directly or indirectly:
copy, reproduce, modify, distribute, publish, sell, licence, lease, scrape, crawl, mirror, benchmark, reverse engineer, decompile, disassemble, extract data from, create derivative works of, interfere with, or otherwise misuse any portion of the Platform, except as expressly permitted by applicable law.
Users shall also refrain from attempting to gain unauthorised access to the Platform, interfere with its security, bypass technical measures, or use automated tools to collect Platform information without prior written authorisation from NexDeys.
The availability of any feature, functionality, service, city, Vendor, offer, promotion, interface, workflow, or capability on the Platform shall not create any permanent obligation upon NexDeys to continue providing the same.
NexDeys reserves the right to introduce, modify, suspend, discontinue, or replace any aspect of the Platform, with or without prior notice, subject to applicable law.
To the maximum extent permitted under applicable law, NexDeys shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, business interruption, loss of goodwill, data loss, or other commercial losses arising from or relating to the use of the Platform.
Nothing contained in this Disclaimer shall exclude or limit any liability that cannot legally be excluded under applicable Indian law.
NexDeys shall not be responsible for any delay, interruption, suspension, or failure in the availability or operation of the Platform arising from events beyond its reasonable control, including natural disasters, floods, earthquakes, fire, epidemics, pandemics, cyber incidents, internet failures, power outages, strikes, governmental actions, payment network failures, telecommunications failures, or other force majeure events.
NexDeys reserves the right to modify, amend, update, or replace this Disclaimer at any time to reflect changes in applicable laws, regulatory requirements, business operations, technological developments, or Platform functionality.
The revised Disclaimer shall become effective upon publication on the Platform unless otherwise required by applicable law. Continued use of the Platform after such updates constitutes acceptance of the revised Disclaimer.
This Disclaimer shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising from or relating to this Disclaimer shall be subject to the jurisdiction of the competent courts having jurisdiction over the registered office of NexDeys (OPC) Private Limited, subject to applicable law.
